These terms of use (terms) govern your access to and use of shahnexus.com.au (the site), operated by Shahwaiz Imran trading as ShahNexus Solutions (ShahNexus, we, us, our), a sole trader based in Melbourne, Victoria, Australia, ABN 22 830 676 605. By accessing or using the site you agree to these terms. If you do not agree, do not use the site.
All content on the site — including service descriptions, package outlines, the bundle configurator, articles, case studies, and any other material — is general information about ShahNexus and what we do. It is not professional, legal, financial, accounting, or technical advice, and must not be relied on as advice. You are responsible for obtaining your own advice before acting on anything you read here.
We aim to keep the site accurate and current, but we make no representation or warranty that any content is accurate, complete, or up to date, and content may change without notice. Case studies and examples describe past work; they are not a promise or prediction of any result for your project.
The site is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all warranties, express or implied, including as to availability, uninterrupted or error-free operation, fitness for a particular purpose, accuracy, and freedom from viruses or other harmful components. You are responsible for your own devices, connectivity, and data backups.
Any packages, inclusions, bundles, indicative budgets, ranges, or figures shown or generated on the site — including anything produced by the "build your own bundle" configurator — are indicative only. They are not an offer capable of acceptance and do not create a contract. The scope, price, deliverables, timeline, and terms of any work are set only in a separate written engagement, proposal, or statement of work agreed by both parties. If there is any inconsistency between the site and a signed engagement, the signed engagement prevails.
Submitting any form on the site does not oblige us to provide services, to respond, or to enter into any engagement. You are responsible for ensuring the information you submit is accurate, lawful, not misleading, not defamatory, and not confidential to, or the property of, a third party without the right to disclose it. Form data is handled as described in our Privacy Policy, including processing outside Australia by our form provider.

Some services referred to on the site — including brand and design, business strategy, and finance and business support — are coordinated by ShahNexus but delivered by independent third-party partners. Those partners are not our employees or agents, and we do not control how they carry out that work. To the maximum extent permitted by law, we are not responsible or liable for the acts, omissions, advice, deliverables, timing, or conduct of any partner. Any claim relating to partner-delivered work is a matter between you and that partner, and any engagement with a partner may be subject to that partner's own terms.
The site relies on third-party services (including Formspree for forms and our website hosting provider) and may link to third-party websites. We do not control and are not responsible for those services or sites, their content, availability, security, or their terms and privacy practices. Your use of them is at your own risk and subject to their terms.
The site and its content — including text, layout, graphics, images, and the ShahNexus name, logo, and other marks — are owned by or licensed to ShahNexus and are protected by intellectual property laws. You may view and print pages from the site for your own personal, non-commercial reference. You must not otherwise copy, reproduce, republish, distribute, or use our content or branding without our prior written permission.
Ownership of any deliverables produced under a paid engagement is dealt with in that engagement. Unless the engagement says otherwise, intellectual property in deliverables passes to the client only on our receipt of payment in full, we retain ownership of our pre-existing materials, tools, methods, and know-how, and we may describe and display the work in our portfolio and marketing.
Non-excludable rights. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded (Non-excludable Rights).
Limitation where permitted. Where we are liable for a failure to comply with a Non-excludable Right and the law permits us to limit that liability, our liability is limited, at our option, to re-supplying the relevant service or content, or paying the cost of having it re-supplied.
Exclusion of other liability. Subject to the Non-excludable Rights, and to the maximum extent permitted by law:
Liability arising under a signed engagement is governed by the terms of that engagement, not by this clause.
To the maximum extent permitted by law, you indemnify ShahNexus and Shahwaiz Imran against all claims, liabilities, losses, costs, and expenses (including reasonable legal costs) arising from or in connection with your use of the site, your breach of these terms, any material or information you submit through the site, or your infringement of any law or any third party's rights.
We may change, suspend, or withdraw the site or any part of it, at any time and without notice. We may also update these terms at any time; the current version is always published on this page with its "last updated" date, and your continued use of the site after a change means you accept the updated terms.
These terms are governed by the laws of the State of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the courts that hear appeals from them.
If any provision of these terms is found to be invalid or unenforceable, it is severed to the minimum extent necessary and the remaining provisions continue in full force. Our failure or delay in enforcing a provision is not a waiver of it.
